1. Purpose of This Policy
Vision Care Management Inc ("Eyebrowse", "we", "our", or "us") provides this Consumer Health Data Privacy Policy to describe how we handle "consumer health data" as that term is defined under laws such as the Washington My Health My Data Act (MHMDA) and comparable state frameworks.
This policy supplements our general Privacy Policy. Where this policy and the general Privacy Policy conflict with respect to consumer health data, this policy controls.
2. Consumer Health Data We Collect
To help you obtain corrective eyewear, we collect a limited set of information that may be treated as consumer health data:
- Prescription (Rx) data you provide or that is supplied by your eye-care provider, used to produce corrective lenses.
- Pupillary distance (PD) and related fitting measurements, used to position lenses correctly.
- Facial geometry captured by your device camera during PD measurement and virtual try-on (for example, the position of your pupils and the bridge of your nose).
3. How We Process Facial Geometry — On-Device and Ephemeral
Facial-geometry processing happens on your device. Camera frames are analyzed in real time to extract the measurement coordinates we need, and they are not transmitted to our servers or stored as part of this feature.
- We do not store your facial images, video, or face scans for the camera measurement and try-on features.
- We do not use facial recognition to identify you. The coordinates we derive are used only to measure and to render glasses on your live preview.
- The numeric PD value you choose to save is stored as a fitting measurement so we can make your eyewear — it is not a facial image or face template.
4. Why We Collect It (Purpose)
We collect and process consumer health data only to provide the eyewear products and fitting services you request — measuring your PD, showing you how frames look on your face, and producing correct corrective lenses. We do not use it for advertising, profiling, or any purpose unrelated to fulfilling your order.
5. We Do Not Sell or Share Your Consumer Health Data
We do not sell consumer health data, and we do not share it with third parties for their own purposes. We do not collect a valid authorization to sell consumer health data because we do not sell it.
We use service providers (for example, an optical lab that produces your lenses) strictly to fulfill your order, under contracts that limit them to that purpose. We disclose data only as needed to provide the service you requested or as required by law.
6. Retention
Facial geometry used for camera measurement and try-on is ephemeral — it is processed on your device and not retained by us.
Prescription and pupillary-distance data tied to an order are retained only as long as needed to fulfill and support that order and to meet legal, accounting, and warranty obligations, after which they are deleted or de-identified. You may request earlier deletion as described below.
7. Consent
Before the camera starts, we show a clear notice and ask you to affirmatively consent to facial-geometry capture for measurement and try-on. You can decline, and the camera will not start. You can complete a purchase without using the camera by entering measurements another way.
8. Your Rights
Depending on where you live, you may have the right to:
- Confirm whether we are processing your consumer health data and access that data.
- Withdraw consent to our collection and processing of your consumer health data.
- Request deletion of your consumer health data.
- Be free from discrimination for exercising any of these rights.
9. How to Exercise Your Rights
To exercise any of these rights, contact us using our contact form or email info@eyebrowseai.com. We will verify your request and respond within the timeframe required by applicable law. You may appeal a denial by replying to our decision; if your appeal is denied, you may contact your state Attorney General.
10. State-Specific Notice
This policy is intended to address consumer-health-data obligations under the Washington My Health My Data Act and similar laws. Residents of other states retain the rights afforded by their own laws, which may differ. We honor applicable rights regardless of the state in which you reside.
